The Excessive Courtroom of Bombay at Goa on Monday struck down a Goa authorities notification reserving 41 per cent publish graduate (PG) seats within the state quota for SC, ST and OBC candidates at Goa Medical Faculty (GMC) and Goa Dental Faculty (GDC) from the 2021-22 tutorial 12 months.
Over 100 docs and medical college students had moved the courtroom final 12 months in opposition to the state authorities’s resolution.
Consistent with SC: ‘Populist consideration
The state’s notification of Might 4, 2020 reserving 12 per cent PG medical seats for STs, 2 per cent for SCs, and 27 per cent for OBCs was partly primarily based on suggestions of the Goa Fee for SC/ST and the Goa Fee for OBC, each of which the courtroom quashed and put aside.
Of their 95-page judgment, Justice M S Sonak and Justice M S Jawalkar mentioned, “Such a severe resolution to order 41 per cent of the state quota seats to PG programs at GMC must have (been) preceded by utility of thoughts to a bunch of related issues referred to in a plethora of choices of the Hon’ble Supreme Courtroom on the topic in addition to the issues flagged by the Dean of GMC in his letter/notings…”
They have been referring to the March 16, 2020, letter of GMC Dean Shivanand Bandekar to state below secretary (well being) that the admission to PG programs in GMC had thus far been with none reservation to SC, ST & OBC class… “The choice for PG seats was carried out purely on the benefit (NEET-PG) rating. This was as a result of PG college students cope with emergencies…with a view to get high quality service, no reservation is stored for any class as GMC is the one medical school in Goa…” he mentioned in his letter.
Following the courtroom’s resolution, the Congress attacked the ruling BJP for its lack of ability to defend in courtroom caste-based reservation in PG medical programs. “This authorities is anti-bahujan samaj… This displays the RSS ideology that has been in opposition to SC, ST, OBCs,” mentioned Goa Congress president Girish Chodankar.
